Introduction

These Terms and Conditions are a binding agreement between you and Ship Car Pros (referred to in these Terms as "Ship Car Pros", "we", "us", or "our") and govern your use of our website and our auto-transport referral service. If you do not agree to these Terms, do not use the site or our service.

Acceptance of Terms

By accessing this site or contacting us about a transport request, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a business or other entity, you represent that you have authority to do so.

Eligibility and User Responsibilities

Age

You must be at least 18 years old and able to form a binding contract under the law of your jurisdiction to use our service.

Accurate information

You agree to provide accurate, current, and complete information about yourself, your vehicle, and your transport needs, including:

  • Vehicle make, model, year, and condition, including any modifications or non-running status;
  • Origin and destination points;
  • Your contact information; and
  • Any special handling requirements.

Prohibited conduct

When using our service, you agree not to:

  • Provide false, misleading, or incomplete information;
  • Use the service to arrange transport of illegal items, controlled substances, or hazardous materials;
  • Use any automated means to access the site or submit requests;
  • Interfere with or disrupt the site, the underlying networks, or any other user's use of the service;
  • Attempt to gain unauthorised access to any portion of the site; or
  • Use the site or service for any unlawful purpose.

Nature of Our Service

Ship Car Pros operates a referral service. We do not transport vehicles, we do not arrange transport ourselves, and we are not a motor carrier, broker, or freight forwarder within the meaning of 49 C.F.R. Part 371 or other Federal Motor Carrier Safety Administration regulations. We connect prospective customers with independent transport providers in our network. Those providers are independent contractors who own their own equipment, set their own prices and schedules, are responsible for their own operating authority and insurance, and contract directly with you.

We do not guarantee:

  • That a transport provider in our network will be available for your specific route, vehicle, or timeframe;
  • The price, delivery date, or service quality offered by any transport provider; or
  • The accuracy of any quote or estimate provided by a transport provider.

Verifying Your Transport Provider

Before engaging any transport provider, you are responsible for verifying that the provider holds the operating authority, registration, and insurance required by federal and state law. You can look up a motor carrier's, broker's, or freight forwarder's interstate operating authority and insurance using the Federal Motor Carrier Safety Administration's tools at fmcsa.dot.gov. We encourage you to also:

  • Review the transport contract carefully before signing it;
  • Document your vehicle's condition before and after transport, including with date-stamped photographs;
  • Confirm pickup, delivery, and pricing details directly with the provider; and
  • Promptly report any issues to the provider and, where appropriate, to the FMCSA or other authorities.

Intellectual Property

The site and its contents, including text, graphics, logos, images, layout, and software, are owned by Ship Car Pros or its licensors and are protected by U.S. and international intellectual-property laws. You may not copy, modify, distribute, sell, or create derivative works of the site or its contents without our prior written permission, except for personal, non-commercial use as permitted by these Terms.

Third-Party Trademarks

All third-party product names, brands, and trademarks referenced on the site are the property of their respective owners. Reference to a third-party brand does not imply affiliation, sponsorship, or endorsement.

Disclaimers

The site and the referral service are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, and we do not warrant the accuracy, completeness, reliability, or quality of any transport provider listed in our network or any service performed by such a provider.

Limitation of Liability

To the fullest extent permitted by law, Ship Car Pros and its officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to:

  • Your use of, or inability to use, the site or the referral service;
  • The acts, omissions, or services of any transport provider, including damage to or loss of your vehicle, delays, or other matters relating to the transport of your vehicle;
  • Any unauthorised access to or alteration of your communications; or
  • Any other matter relating to the site or the referral service.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the referral service will not exceed one hundred U.S. dollars (US$100). Your sole remedy in connection with any transport service is to seek resolution directly with the transport provider you engaged.

Indemnification

You agree to defend, indemnify, and hold harmless Ship Car Pros and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the site or the referral service, your violation of these Terms, or your violation of any law or the rights of any third party.

Payment and Fees

The referral service is provided to you free of charge. Ship Car Pros is compensated by transport providers in its network for successful referrals. All transport costs, fees, and payment terms are set and collected by the transport provider you select. Ship Car Pros is not a party to, and is not responsible for, any payment or billing dispute between you and a transport provider.

Termination

We may suspend or terminate your access to the site or the referral service at any time, with or without notice and with or without cause, including for breach of these Terms. The provisions of these Terms that by their nature should survive termination, including the disclaimers, limitations of liability, indemnification, and dispute-resolution provisions, will survive.

Dispute Resolution and Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to bring a lawsuit in court and to participate in a class action.

Agreement to arbitrate

You and Ship Car Pros agree that any dispute, claim, or controversy arising out of or relating to these Terms, the site, or the referral service (including any question regarding the existence, validity, interpretation, or termination of these Terms) will be resolved exclusively through final and binding individual arbitration, except as set out below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.

Individual basis only; class-action waiver

You and Ship Car Pros agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or class proceeding.

Carve-outs

The following claims are not subject to arbitration: (a) claims that may be brought in small-claims court, provided the claim remains in that court and proceeds only on an individual basis; and (b) claims for injunctive or other equitable relief to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual-property rights, which may be brought in a court of competent jurisdiction.

30-day opt-out

You may opt out of this arbitration agreement by sending us written notice within 30 days after first agreeing to these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of the arbitration agreement. Opting out will not affect any other portion of these Terms.

Jury-trial waiver

To the fullest extent permitted by law, you and Ship Car Pros each waive any right to a jury trial in any dispute arising out of or relating to these Terms or the referral service.

Governing law

These Terms are governed by the laws of the State in which Ship Car Pros maintains its principal place of business, without regard to its conflict-of-laws principles, and by the Federal Arbitration Act with respect to this arbitration agreement.

Severability

If any portion of this arbitration agreement is found to be unenforceable, the remainder will continue in force, except that if the class-action waiver is found to be unenforceable, the entire arbitration agreement will be void.

Accessibility

Ship Car Pros is committed to making its website accessible to as many users as possible and works toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the effective date below. Your continued use of the site or the referral service after the updated Terms take effect means that you accept the updated Terms.

Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ship Car Pros with respect to the site and the referral service. Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision. If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect. You may not assign these Terms without our prior written consent; we may assign these Terms at any time. These Terms are effective as of 2026.
